Welcome to Aegir Consulting (“Company”, “Aegir” “we”, “our”, “us”). These Terms of Service (“Terms”) govern your use of our website located at www.aegirlegal.com (the “Site”) and our immigration & naturalization consulting services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. Introduction

These General Terms and Conditions (hereinafter referred to as “GTC”) set forth the terms and conditions for the use of services provided by Aegir Consulting Kft. (Headquarters: Budapest, Hillside District 1126, Marvany Street, Bulding 29., company registration number: 01-09-431273, tax number: 23571613-2-43, statistical number: 32571613-7022-113-01, hereinafter referred to as “Service Provider”), as well as the rights and obligations between the Service Provider and the individual or legal entity using the services (hereinafter referred to as “Client” or “Partner”).

The GTC applies to all contracts concluded between the Service Provider and the Client (Partner) regarding the use of services provided by the Service Provider.

2. Scope and Subject Matter of the General Terms and Conditions

2.1. Scope of the GTC: These GTC apply to all contracts concluded between the Service Provider and the Client (Partner) in relation to immigration, migration consulting, and other related services provided by the Service Provider. The GTC forms an integral part of any contract concluded with the Client.

2.2. Subject Matter of the GTC: The main activity of the Service Provider is to facilitate the settlement, employment, and investment of third-country nationals in Hungary. The scope of services includes administrative support, consultancy, and mediation in various immigration and legal processes.

3. Description of Services

3.1. The services provided by the Service Provider may include, but are not limited to:

  • Administrative and legal support related to residence permits;
  • Mapping and support of investment opportunities in Hungary;
  • Consultancy and execution of administrative procedures for business establishment;
  • Application and related consultancy for work permits;
  • Other legal, business, and administrative services related to migration.

4. Formation and Amendment of the Contract

4.1. The contract comes into effect upon the Client’s (Partner’s) acceptance of the Service Provider’s offer and payment of the agreed fee. The provisions of these GTC apply to the formation of the contract.

4.2. The Service Provider reserves the right to unilaterally amend the GTC. The amended GTC shall enter into force upon publication on the website and apply to already concluded contracts unless otherwise agreed by the parties.

5. Fees and Payment Terms

5.1. The Client (Partner) is obliged to pay the fee specified in the contract within the given payment deadline to the Service Provider.

5.2. Payment can be made via bank transfer or in cash by prior agreement. The Service Provider will issue an electronic invoice containing payment details in all cases.

5.3. Aegir Consulting Kft. requires a deposit from the Client (Partner) at the start of the service, which is a percentage of the total fee. The remaining amount must be paid according to the schedule set by the Service Provider, considering the progress of the work and the information provided by the Client.

5.4. If the Client (Partner) terminates the contract in a manner or at a time different from that stipulated, Aegir Consulting Kft. is entitled to retain the amounts paid so far to cover the work already performed and the incurred costs. In such cases, the Client (Partner) may not demand a refund of the fees paid unless the termination is due to a serious breach of contract by the Service Provider.

5.5 The Client (Partner) is required to pay a fee of 20,000 HUF + VAT per hour for the consultation with Aegir. This amount will be deducted from the total price in the event that a contract is concluded between Aegir and the Client (Partner).

6. Obligations of the Client (Partner)

6.1. The Client (Partner) is required to provide all data and documents necessary for the completion of the service to the Service Provider.

6.2. The Client (Partner) is responsible for the accuracy, completeness, and legality of the provided data and documents. The Service Provider shall not be held liable for any delays or damages arising from incomplete or inaccurate information provided by the Client (Partner).

7. Rights and Responsibilities of the Service Provider

7.1. The Service Provider commits to providing its services in accordance with general professional standards and to the best of its abilities.

7.2. The Service Provider does not guarantee the achievement of the desired outcome for the Client, especially regarding decisions and timing of the authorities.

7.3. The Service Provider is entitled to suspend the service or terminate the contract with immediate effect in case of the Client’s (Partner’s) breach of obligations under the contract.

8. Data Processing and Privacy

8.1. The Service Provider handles the personal data of the Client (Partner) in accordance with applicable data protection laws and uses it solely for the purpose of fulfilling the service.

8.2. The Client (Partner) is entitled to request information about the processing of their personal data, as well as to request the modification, deletion, or blocking of their data in accordance with data protection laws.

8.3 The Service Provier may use third-party service providers to monitor and analyze the use of our Services. These service providers may collect and store information on our behalf. By using our Services, you consent to such monitoring and analysis.

9. Dispute Resolution

9.1. Any disputes arising between the Client (Partner) and the Service Provider in connection with the contractual relationship shall primarily be resolved through peaceful negotiations.

9.2. If negotiations do not lead to a resolution, the applicable law shall be Hungarian law, and the exclusive jurisdiction of Hungarian courts is agreed upon for the resolution of disputes. The parties explicitly agree that the contract and the resulting legal relationships shall be governed by the laws in force in Hungary, regardless of the nationality or registered office of the Client (Partner).

10. Release of Liability

10.1 General Liability

To the maximum extent permitted by applicable law, Aegir Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.

10.2 User-Generated Content

You acknowledge that you are solely responsible for all content you upload, post, email, transmit, or otherwise make available through our Services. Aegir Consulting shall not be liable for any claims arising from such content. You agree to indemnify and hold Aegir Consulting harmless from any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your content or your breach of these Terms.

11. Refunds

All payments made to Aegir Consulting are non-refundable except as provided under specific terms outlined in the applicable contractual agreement. By purchasing our Services, you acknowledge and agree that you are not entitled to an immediate refund, rebate, compensation, or restitution unless otherwise stated in the contract or agreed upon in writing.

12.2 Filing a DMCA Notice

To be effective, the notification must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
